司法實踐中，民事案件中拒不履行生效判決、裁定是司法拘留適用最為普遍的一種情形。
行政拘留之所以把孕婦排除在外，主要是出于人道主義考慮。似乎根據一般推論，司法拘留同行政拘留一樣都是在短時間內限制當事人的人身自由，故亦應當類比行政拘留而規定將包括孕婦在內的特殊對象排除在外。但目前的法律規定并非如此。為了維護法律的尊嚴，保障法院審判工作的順利進行，不對特殊對象免予拘留具有現實的必要性。
