對投保人而言，在保險責任開始前，可以對保險合同行使解除權，而在保險責任開始后，法律對投保人的解除權作出了兩種不同的規定：對財產保險合同而言，投保人要求解除合同的，保險人可以收取自保險責任開始之日起至合同解除之日止期間的保險費，剩余部分退投保

(2)投保人、被保險人未履行合同義務。在財產保險合同中，投保人、被保險人未按照約定履行其對保險標的的安全應盡的責任，保險人有權解除合同。
(3)被保險人危險增加通知義務的違反。在保險合同有效期內，保險

一、保險合同如何解除,怎么解除保險合同
保險合同的解除，一般分為法定解除和意志解除兩種形式。
1、法定解除。法定解除是指當法律規定的事項出現時，保險合同當事人一方可依法對保險合同行使解除權。法定解除的事項通常由法律直接規定。但是，不同的主體有不盡相同的法定解除事項。
對投保人而言，在保險責任開始前，可以對保險合同行使解除權，而在保險責任開始后，法律對投保人的解除權作出了兩種不同的規定：對財產保險合同而言，投保人要求解除合同的，保險人可以收取自保險責任開始之日起至合同解除之日止期間的保險費，剩余部分退投保

(2)投保人、被保險人未履行合同義務。在財產保險合同中，投保人、被保險人未按照約定履行其對保險標的的安全應盡的責任，保險人有權解除合同。

2、意定解除。意定解除又稱協議終止，是指保險合同雙方當事人依合同約定，在合同有效期內發生約定情況時可隨時解除保險合同。意定解除要求保險合同雙方當事人應當在合同中約定解除的條件，一旦約定的條件成就，一方或雙方當事人有權行使解除權，使合同的效力歸于消滅。
二、解除保險合同有無違約責任?
簽訂保險合同后想解除合同是否需要承擔違約責任呢?根據保險法的規定，不涉及違約責任問題。一般分兩種解除情況，一種是保險責任開始前，投保人要求解除合同的，向保險人支付手續費后，保險人將退還保險費。另一種是保險責任開始后，投保人要求解除合同的，此時保險人收取自保險責任開始之日起至合同解除之日止期間的保險費，剩余部分將退還投保人。”
